Who Can Buy and What Is the Legal Framework?

Under Article 35 of the Turkish Land Registry Law, foreign individuals may acquire residential, commercial, and land properties in Turkey. The total land area a foreigner can own is capped at 30 hectares — a limit that is irrelevant for standard residential purchases. A Foreign Exchange Purchase Certificate (Döviz Alım Belgesi) proving that the purchase price was brought into Turkey in foreign currency must be obtained before title transfer.

The Buying Process: Step by Step

The process typically involves: (1) Property selection and valuation, (2) Signing a preliminary sale agreement and paying a deposit, (3) Identity verification at the Land Registry Office and obtaining a Turkish Tax ID, (4) Title deed transfer and payment of fees, (5) Receiving the title deed (tapu). The entire process usually takes 2–4 weeks; with a notarised power of attorney, the buyer does not need to be present in Turkey in person.

Costs and Taxes

The buyer typically pays title deed transfer tax of 4% of the declared sale price, which can legally be shared equally between buyer and seller. Additional costs include compulsory earthquake insurance (DASK), the Land Registry office service fee, and — if applicable — interpreter fees. Annual property tax ranges from 0.1% to 0.3% of assessed value depending on property type and location.
