The Turkish Code of Obligations governs the relationship between tenants and landlords in considerable detail. Whether you are renting or leasing a property, knowing your rights and obligations will protect you from unnecessary disputes.

Rent Increase Rules

A regulation introduced in 2022 capped residential rent increases at the CPI rate at the time of contract renewal. Although this rule was reviewed again in late 2024, the CPI reference continues to serve as the practical benchmark. Landlords cannot impose an increase above the legally determined rate; if they do, the tenant may apply to the court for a rent determination ruling.

Tenant Rights

A tenant cannot be forced to vacate a property while the tenancy agreement remains in force. For a landlord to demand eviction, one of the limited statutory grounds (such as the landlord's need to use the property personally, or a mandatory renovation) must be present. To reclaim a security deposit, the tenant must submit a formal request within 10 days of the handover date.

Landlord Rights and Obligations

While the landlord has the right to receive rent on time, they are responsible for keeping the property in habitable condition. Major repairs — plumbing, roof, heating system — generally fall to the landlord; minor maintenance and upkeep are the tenant's responsibility. Unless the agreement stipulates otherwise, the landlord is responsible for obtaining compulsory earthquake insurance (DASK).

Key Clauses to Check in Your Contract

A tenancy agreement must be in writing, clearly stating the rent amount, payment date, security deposit, contract duration, and who is responsible for service charges. For foreign tenants, obtaining a notarised translation of the contract provides both legal certainty and a useful document for identity and residence-related applications.
